In short: Whale Atlas is free and for information only. It is not advice, it comes with no guarantees, and data may be late or wrong.
You are responsible for your own decisions. Don’t misuse congressional disclosure data, don’t overload the site, and please credit Whale Atlas when you share.
1. Agreement to these terms
These Terms of Use (“Terms”) govern your use of the Whale Atlas website, its pages, data, charts, share images and any related services (the “Service”), which are provided by the independent operator of Whale Atlas (“we”, “us”). By accessing or using the Service you agree to these Terms, to our Privacy Policy and to our Not Financial Advice notice, which are part of these Terms. If you do not agree, do not use the Service.
2. What the Service is
Whale Atlas is a free, informational and educational publication that collects, organizes and displays information from public government filings, including SEC Form 4 insider transaction reports and U.S. House and Senate periodic transaction reports, together with delayed market reference data and experimental, rule-based summaries.
The Service does not provide investment, financial, legal or tax advice, does not recommend any security or transaction, and is not tailored to anyone. Everything on it is general information that you must verify independently. See the Not Financial Advice notice.
3. Who may use the Service
The Service is intended for adults. It is not directed to children under 13, and you must be at least 13 years old (and old enough to agree to these Terms where you live) to use it. You are responsible for complying with the laws that apply to you, including any rules on investing and trading.
4. Acceptable use
You agree not to:
- use the Service for any unlawful purpose, or to harass, threaten, defame or harm any person named in a filing;
- use congressional financial disclosure information obtained through the Service for any purpose prohibited by federal law, including any commercial purpose (other than by news and communications media for dissemination to the general public), to determine or establish anyone’s credit rating, or directly or indirectly in the solicitation of money for any political, charitable or other purpose (see 5 U.S.C. § 13107);
- scrape, crawl, copy or download the Service in bulk or at a rate that burdens it, or resell, sublicense or republish its compiled data or scores as a product or service, except as allowed below;
- interfere with, probe or attack the Service or its security, or try to access areas that are not public;
- present the Service’s information as your own advice, or suggest that Whale Atlas endorses you or any security.
You may link to any page, use the share buttons and share images, and quote reasonable excerpts for commentary, news or research, as long as you credit Whale Atlas and do not remove source links or disclaimers. Search engines and AI assistants may index and cite public pages in line with our robots.txt.
5. Data, sources and ownership
Government filings shown on the Service are public records, and the underlying facts belong to no one. If the Service ever differs from an original filing, the original filing controls. Each trade links to the original filing on the government website. Third-party material is credited where shown: charts are embedded from TradingView under its terms; company descriptions come from Wikipedia under the CC BY-SA 4.0 license and Wikidata (CC0); other public datasets are credited on the data sources page.
Trade data on the Service is collected directly from the government and never from another trade-tracking service; see how records are sourced. The Service’s design, software, text, logo, name, compilations, rankings and scores were developed independently and are owned by us or our licensors. Subject to these Terms, we grant you a limited, personal, non-exclusive, revocable license to use the Service for your own non-commercial information and research.
6. Third-party sites and services
The Service links to and embeds content from third parties, including government websites, TradingView and Wikipedia. We do not control them and are not responsible for their content, availability, accuracy or privacy practices. Your use of them is subject to their own terms.
7. No warranties
The Service and all information on it are provided “as is” and “as available”, with all faults and without warranties of any kind, whether express, implied or statutory, including warranties of accuracy, completeness, timeliness, merchantability, fitness for a particular purpose, title and non-infringement. We do not warrant that the Service will be uninterrupted, secure or error-free, that data is correct or current, or that any defect will be corrected.
8. Limitation of liability
To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, trading or investment losses, lost opportunities, loss of data or goodwill, arising out of or relating to the Service or these Terms, however caused and under any theory of liability, even if we were told such damages were possible. Because the Service is provided free of charge, our total liability for all claims relating to the Service is limited to fifty U.S. dollars (US$50). Nothing in these Terms limits liability that cannot be limited under applicable law.
Some jurisdictions do not allow certain limitations, so some of the above may not apply to you; in that case our liability is limited to the smallest amount allowed by law.
9. Your responsibility
You are solely responsible for your decisions, trades and their results. To the extent permitted by law, you agree to indemnify and hold us harmless from any claims, losses and expenses (including reasonable legal fees) arising from your use or misuse of the Service or your breach of these Terms.
10. Changes to the Service and these Terms
The Service is free and may change, pause or stop at any time, with or without notice. We may update these Terms; the date at the top shows the latest version. Continuing to use the Service after an update means you accept the updated Terms.
11. Governing law and disputes
These Terms are governed by the laws of California, without regard to conflict-of-law rules, and any dispute will be resolved in the state or federal courts located in California, except that either party may bring an individual claim in small-claims court.
Informal resolution first. Before starting any legal proceeding about the Service, you agree to send us a written notice describing the issue and what you want, and to try in good faith to resolve it with us for at least 30 days. This does not prevent either side from seeking emergency injunctive relief. Our legal notices process explains how to reach us; most concerns can be resolved by a quick correction.
12. General
If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. These Terms, the Privacy Policy and the Not Financial Advice notice are the entire agreement between you and us about the Service.
